A judge has reserved their decision in the court case of an Inverness Co. native asking officials with Cabot Links for land use declarations.
Neal Livingston, of Mabou, says closing arguments wrapped up Monday; five days were set aside for hearings in Nova Scotia Supreme Court in Port Hawkesbury.
He says the judge said it would take about a month for a decision on the matter.
Derek Simon, Livingston’s lawyer, has said Cabot officials are planning to go ahead with the construction of nine cottages, but Livingston says restricting beach access is concerning.
Livingston is asking for a declaration of dedication for public use, an injunction preventing Cabot officials from denying public access, and to have a proclamation in the land registry noting the property has been dedicated for public use.
