Cab driver's appeal dismissed

The appeal for an Antigonish cab driver found guilty of sexual assault will not go ahead.

William Roger MacLellan, 50, was in the process of appealing his Nov. 2016 conviction when he died suddenly in April; his lawyer said the trial judge didn't properly apply laws of identification or voice identification evidence, among other things.

The Crown had previously dropped a second charge.

An application to have his appeal continue posthumously through his personal representative was denied in a Nova Scotia Supreme Court ruling released Tuesday.

An 18-year-old university student told police she was touched inappropriately for a sexual purpose when she was being driven home alone in a taxi in 2014; she said MacLellan put his hands down her pants after she got into his cab.

RCMP say a 19-year-old reported a similar incident eight months later.
